Terms of Service

1. Acceptance of these Terms

By accessing or using Honeygasm, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the service.

We may update these Terms. If a change is material, we will provide at least 14 days' advance notice through the service, by email, or by another reasonable method, unless a shorter period is necessary for legal, security, or urgent operational reasons. Your continued use after the effective date means you accept the updated Terms.

2. Eligibility

You must be at least 13 years old to use Honeygasm. If you are under the age of majority where you live, you may use the service only with permission from a parent or legal guardian. Your parent or legal guardian must review and agree to these Terms on your behalf and is responsible for your use of the service.

You may not use Honeygasm if applicable law prohibits you from doing so or if we previously suspended or terminated your access for violating these Terms.

3. Accounts and authentication

You may need an account to use some parts of Honeygasm. You agree to provide accurate information, keep your account and sign-in credentials secure, and promptly notify us at support@honeygasm.com if you suspect unauthorized access. You are responsible for activity through your account to the extent permitted by law.

You may not impersonate another person, use another person's account without permission, or create an account through unauthorized automated means.

4. The service and AI-generated content

Honeygasm provides AI-generated character conversations and interactive fictional experiences. Characters and their responses are fictional. They are not real people or professionals and do not have human judgment, feelings, or independent intent.

AI-generated content may be inaccurate, incomplete, unexpected, repetitive, or objectionable. Do not rely on it for medical, legal, financial, mental-health, emergency, or other professional advice. You are responsible for evaluating whether content is appropriate for your circumstances.

We may add, modify, suspend, or discontinue any part of Honeygasm. We do not guarantee that any feature, character, conversation, or other content will remain available or that the service will be uninterrupted, secure, or error-free.

5. Your content

Your content includes messages, prompts, profile information, feedback, and other material you submit to the service. You retain any rights you have in your content.

You grant Honeygasm a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, display, modify, and create responses from your content only as reasonably necessary to provide, personalize, secure, maintain, support, and improve the service; comply with law; and enforce these Terms. This license lasts for as long as necessary for those purposes, including any retention period described in our Privacy Policy. It does not authorize Honeygasm to use your content in advertising or to sell your content.

You represent that you have the rights needed to submit your content and grant this license. Do not submit confidential information, sensitive personal information, or information about another person unless you have the right to do so and are comfortable with it being processed to provide the service.

6. AI output

Subject to applicable law and the rights of others, as between you and Honeygasm, you may use AI-generated output provided to you through the service for personal, non-commercial purposes. We do not represent or warrant that output is unique, protectable by intellectual property law, or free from similarity to content generated for other users.

These Terms do not transfer to you any rights in Honeygasm's software, characters, branding, prompts, system instructions, visual assets, or other service materials.

7. Acceptable use

You agree not to misuse Honeygasm or help anyone else misuse it.

• Do not violate any law or another person's rights.
• Do not exploit, endanger, sexualize, or harm a minor, including by creating, requesting, possessing, or sharing child sexual abuse material or other sexual content involving minors.
• Do not create or share non-consensual intimate content or content that facilitates sexual exploitation.
• Do not threaten, harass, stalk, defame, or encourage violence against a person or protected group.
• Do not infringe intellectual property, privacy, publicity, confidentiality, or other rights.
• Do not attempt to bypass safety systems, authentication, rate limits, access controls, or security protections.
• Do not scrape, reverse engineer, probe, overload, interfere with, or disrupt the service, except where applicable law expressly permits.
• Do not distribute malware, spam, scams, or instructions intended to facilitate wrongdoing.
• Do not use unauthorized bots or automated systems to access the service.
• Do not impersonate others or misrepresent your identity, affiliation, or authority.
• Do not use the service in any other way that creates a material safety, legal, or security risk.

8. Moderation and enforcement

We may investigate suspected violations and may restrict, remove, preserve, or disclose content, or suspend or terminate accounts, when we reasonably believe doing so is necessary to operate or secure the service, protect users or others, enforce these Terms, or comply with law.

We are not required to monitor all content. Where appropriate and legally permitted, you may contact support@honeygasm.com to ask about an account restriction or termination.

9. Intellectual property

Honeygasm, including its software, design, branding, characters, prompts, system instructions, visual assets, and other non-user materials, is owned by Honeygasm or its licensors and is protected by intellectual property laws.

Subject to these Terms, Honeygasm grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the service for its intended purposes. You may not copy, sell, license, distribute, or create a competing service from Honeygasm materials except as these Terms or applicable law expressly permit.

If you provide feedback or suggestions, you grant Honeygasm a perpetual, worldwide, irrevocable, royalty-free right to use them without restriction or compensation, provided that we do not identify you publicly as the source without permission.

10. Third-party services

The service may depend on or link to third-party authentication, hosting, AI, analytics, or other services. Honeygasm does not control third-party services and is not responsible for their separate terms, content, or practices. Your use of a third-party service may be governed by that provider's terms and privacy policy.

11. Copyright complaints

If you believe material available through the service infringes your copyright, contact support@honeygasm.com with identification of the copyrighted work, the allegedly infringing material and its location, your contact information, a good-faith statement, a statement under penalty of perjury that your notice is accurate and you are authorized to act, and your physical or electronic signature. We may remove allegedly infringing material and terminate repeat infringers where appropriate.

12. Suspension and termination

You may stop using the service at any time. You may request account deletion through account tools made available in the service or by contacting support@honeygasm.com.

We may suspend or terminate your access, with or without notice, if you violate these Terms, create risk or possible legal exposure, or if we discontinue the service. Provisions that by their nature should survive termination will survive, including provisions concerning intellectual property, disclaimers, limitations of liability, indemnity, disputes, and general terms.

13. Disclaimer of warranties

Honeygasm is provided "as is" and "as available." To the maximum extent permitted by law, Honeygasm and its affiliates, licensors, and service providers disclaim all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and security.

We do not warrant that the service or AI-generated content will meet your requirements, be uninterrupted or error-free, or be free of harmful components. Some jurisdictions do not allow certain warranty disclaimers, so some of these disclaimers may not apply to you.

14. Limitation of liability

To the maximum extent permitted by law, Honeygasm and its affiliates, officers, directors, employees, agents, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or service interruption, arising out of or related to the service or these Terms.

To the maximum extent permitted by law, their total aggregate liability for all claims arising out of or relating to the service or these Terms will not exceed the greater of $100 or the amount you paid Honeygasm for the service during the 12 months before the event giving rise to the claim.

These limitations apply regardless of the theory of liability and even if a remedy fails of its essential purpose. They do not limit liability that cannot be limited under applicable law.

15. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Honeygasm and its affiliates, officers, directors, employees, and agents from claims, liabilities, damages, losses, and reasonable legal fees arising from your content, your misuse of the service, or your violation of these Terms or another person's rights. We may control the defense of a matter covered by this section, and you agree to cooperate with that defense.

16. Governing law and disputes

These Terms and disputes arising out of or relating to the service will be governed and resolved under applicable law. Nothing in these Terms limits any non-waivable consumer right or access to a court or forum that applicable law requires.

17. General terms

These Terms and any additional terms expressly presented for a particular feature form the entire agreement between you and Honeygasm concerning the service. If a provision is unenforceable, it will be modified only as much as necessary and the remaining provisions will remain in effect.

Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, or by operation of law. Section headings are for convenience only.

18. Electronic communications

You consent to receive agreements, notices, disclosures, and other communications electronically, including through the service or by email. Electronic communications satisfy any legal requirement that communications be in writing, to the extent permitted by law.
